NOTICE OF PUBLIC HEARING BY THE BOARD OF ADJUSTMENT
ON A REQUEST TO AMEND CONDITIONS ON A CONDITIONAL USE PERMIT

Notice is hereby given that a Public Hearing will be held by the Codington County Board of Adjustment on Monday, March 30, 2026, at 6:30 p.m. in the Codington County Extension Complex to consider, in full or in part, a request to amend conditions placed on the following Conditional Use Permit:

• A Conditional Use Permit Pursuant to Section 3.04.02.08 Class 1 Concentrated Animal Feeding Operation issued on August 20, 2007, to MoDak Dairy, Inc. on property legally described as the SE1/4, less Greg Moes Addition in Section 26-T117N-R51W and the MoDak Addition in SW1/4 of Section 25-T117N-R51W, Codington County, South Dakota.

The applicant seeks to amend the conditions placed on his original permit issued August 20, 2007. The public hearing will be held in reference to the applicant’s request to:

• Expand the number of cattle approximately 1,700 head for a maximum operational size of up to 7,450 Animal Units; and
• Expand to property legally described as: The East 987’ of the SW1/4 of Section 25-T117N-R51W, Codington County, South Dakota

All persons interested therein may appear and be heard before the Board of Adjustment at said hearing. Please note, only comments applicable to the requested (above described) amendment will be allowed.  All application information, reports, and written comments will be posted at or before 4:30 p.m. on Friday, March 27, 2026, on the planning and zoning page of the Codington County Website at: https://www.codington.org/zoning-office/. Written comments may be filed with the Zoning Officer at 1910 W. Kemp Avenue by noon on or before Friday, March 27, 2026.
