NOTICE OF PUBLIC HEARING BY THE BOARD OF ADJUSTMENT
ON A REQUEST TO AMEND CONDITIONS ON A CONDITIONAL USE PERMIT
Notice is hereby given that a Joint Public Hearing will be held by the Codington County and City of Watertown/Codington County Joint Board of Adjustment on Monday, July 20, 2026 at 7:30 p.m. in the Codington County Extension Complex to consider, in full or in part, a request to amend conditions placed on the following conditional use permit:
- A Conditional Use Permit Pursuant to Section 3.04.02.08 Class 1 Concentrated Animal Feeding Operation issued on September 21, 2020 to TJ Farms, LLC (by Jeff Popham) on property legally described as the SE1/4 and the W1/2 of the SW1/4 of Section 9-T117N-R54W, Codington County, South Dakota.
The applicant seeks to amend the conditions placed on his original permit and at a meeting of the Board of Adjustment on June 26, 2023 following the directive of corrective actions prescribed by the City of Watertown/Codington County Joint Board of Adjustment (Joint Board). The public hearing will be held in reference to the applicant’s request to amend Section 2.f of the Conditions prescribed by the Codington County Board of Adjustment by removing the language in strikethrough font and adding the language in bold/underline font below:
- Grantor agrees that any manure spread within the Codington County/City of Watertown Joint Jurisdiction area shall be incorporated or injected within 48 hours of being applied to the field, with no winter or fall application on snow or frozen ground; and not more than one application in consecutive (Fall/Spring or Spring/Fall) seasons.
Since the amendment was required in support of a corrective action established by the Joint Board, the Joint Board will first make a recommendation regarding the amendment. The Board of Adjustment will then consider the above referenced change to the conditions, with or without amendment.
All persons interested therein may appear and be heard before the Board of Adjustment at said hearing. Please note, only comments applicable to the requested (above described) amendments will be allowed. All application information, reports, and written comments will be posted at or before 4:30 p.m. on Friday, July 17, 2026 on the planning and zoning page of the Codington County Website at: https://codington.sdcounty.gov/zoning-office/. Written comments may be filed with the Zoning Officer at 1910 W. Kemp Avenue by noon on or before Friday, July 17, 2026.
