NOTICE OF PUBLIC HEARING BY THE BOARD OF ADJUSTMENT
ON A REQUEST TO AMEND CONDITIONS ON A CONDITIONAL USE PERMIT

Notice is hereby given that a Public Hearing will be held by the Codington County Board of Adjustment on Monday, June 15, 2026 at 7:30 p.m. in the Codington County Extension Complex to consider, in full or in part, a request to amend a condition on the following conditional use permit:

• A Conditional Use Permit Pursuant to Section 3.04.02.11 Substations. The applicant, Crowned Ridge Wind LLC and Crowned Ridge Energy Storage, LLC, is requesting to construct a substation with accessory uses including battery storage facility on property located in Zemlicka Addition in N1/2 of Section 11-T118N-R51W owned by Crowned Ridge Wind LLC; and property owned by Raynelle Mueller and Bryan Zemlicka described as Zemlicka Second Addition in N1/2 of Section 11-T118N-R51 West of the 5th P.M., Codington County, South Dakota.

The applicant seeks to amend the expiration date of the permit placed on the original permit and at a meeting of the Board of Adjustment on May 20, 2024.  The public hearing will be held in reference to the applicant’s request to:

• Amend the expiration of the permit without commencement of actual construction from September 17, 2026 to expiration date of September 17, 2027 in accordance with Section 4.05.01.9.a of the Codington County Zoning Ordinance.

All persons interested therein may appear and be heard before the Board of Adjustment at said hearing. Please note, only comments applicable to the requested (above described) amendments will be allowed.  All application information, reports, and written comments will be posted at or before 4:30 p.m. on Friday, June 12, 2026 on the planning and zoning page of the Codington County Website at: https://www.codington.org/zoning-office/.  Written comments may be filed with the Zoning Officer at 1910 W. Kemp Avenue by noon on or before Friday, June 12, 2026.
