Lake Township Codington County Ordinance
AN ORDINANCE ENTITLED MAINTENANCE OF TOWNSHIP RIGHT-OF-WAYS 2026
Be it ordained by Lake Township pursuant to SDCL 31-31 sections 2,3,4,5, & 6 that:
- The time for grass, weeds and/or brush to be cut and removed or destroyed along all roads within Lake Township is between the 1st day of September and the 1st day of October 2026.
- All trees, rocks, equipment, and/or other obstruction must be removed from any township right-of-way immediately but not later than June 1, 2026.
- All baled hay should be removed from right-of-way as soon as possible after baling but no later than November 1, 2026.
- No snow from yards and/or driveways may be piled in a township right-of-way.
- Pursuant to SDCL 31-31 sections 5 & 6, if such grass, weeds, trees, brush, rocks, equipment, snow etc. is not removed during or by the specified time period the Supervisors of Lake Township shall employ such person or persons to remove said obstructions etc. at a rate to be set or bid and will be paid by the township. Mowing of road shoulders will be at a rate of $150 per ½ mile with a minimum charge of $150. These costs, plus an administration fee of up to $500, plus any associated Attorney fees paid by Lake Township, will be assessed as a tax on the adjoining land where the obstructions were removed and said tax shall be collected from the landowner as another tax pursuant to the provisions of SDCL 31-31.
